Question:
My brother in law was just arrested and put on psych watch by the Army. Will they be able to hold him?

My brother in law is in the reserves. He has somehow managed to remain un deployed for well over 8 yrs by claiming he lives in an area with an undeployable unit, even though he lives neary 300 miles away. He has committed numerous crimes and yet never seems to ever get in trouble. In 2010 he drove with my two 10 yr old nephews to school while drunk and under the influence of Ambien, getting into an accident with them in the vehicle (no one was hurt thankfully). The police just shrugged shoulders and he was released after claiming he mistakenly took one extra pill (no mistake, he does it every night). 6 months later he got drunk and into a fight with my sister, he threatened her life (and his brothers) with a gun then fired a shot into ceiling- I woke up after the shot and got the kids outside where they were safe until police arrived. He claims he was trying to commit suicide and again police shrugged and he was released. 9 months later he gets into another fight with my sister and comes home drunk. Swallows a bunch of pills while on the phone to his first ex-wife screaming he was going to die from the pills. Then I come home with my nephews and his own 10 yr old son runs inside and he screams to his kid he dying, which of course freaks the kid out. Shortly after and while im AGAIN on the phone with 911 he comes out of the house stumbling and lays on the ground screaming hes dying and my sister shows up. He jumps up and hits her in the leg and I intervene whereupon he strikes me 3 times. No biggie Im a big dude and dont budge. He then staggers off down to the end of the drive and lays down and screams he is dying (yeah a drama queen lol). The police then haul him to the hospital and pump him clean with no effect to him since he made certain he would saved. Then the police AGAIN release him, never taking or pressing any charges for the assaults or suicide attempts. Then today the MPs show up and haul him off for a psych eval and say something about charging him with the felony child abuse from the driving incident. If the army is finally going to do something to this loser I want them to make sure he stays there for awhile and gets the help he needs while my family is safe from him and hopefully never sees him again. Will they be able to hold him until his trial? Should I call his commanding officer and let them know EVERYTHING he has done? (oh theres tons more numerous assaults, food stamp/welfare fraud, lying to his commanding officers, lying about his location, lying about a head injury to collect military benefits, threatening to kill his wife and her entire family on and on...)

Contact his post Provost Marshall and provide a statement.

The military follows the "Uniform code of Military Justice" They are different laws as with the civilian life...They can keep him as long as they like, but will most likely evaluate him then take action from there.

Unless you want to keep putting up with it. He may learn his lesson as it is; if not I would write it down with as much detail as possible including dates and witnesses for future reference. We are all responsible for our actions.

His children need to learn good lessons not bad ones. Good luck.

They can keep him for observation (for a while), but must let him go unless he is a danger to himself or others.
